Terms and Conditions – Project Laut Diving

These Terms & Conditions apply to all services provided by Project Laut Diving (“we”, “us”, “our”, “the Company”) including, but not limited to: scuba diving, snorkelling, boat trips, training courses, guided dives, equipment rental, and any related logistics or surface support.

By booking any activity with Project Laut Diving—whether online, by message, by email, by phone, through an agent, or in person—you (“Guest”, “you”, “your”) confirm that you have read these Terms & Conditions and that you unconditionally agree to be bound by them.

These Terms & Conditions are intended to set clear expectations about booking confirmation, payments, cancellations, refunds, rescheduling, insurance requirements, health screening, operational modifications, and liability allocation.

By participating in any activity arranged, organised, or conducted by Project Laut Diving, you certify and acknowledge all of the following:

Your acceptance on any scuba diving and/or snorkelling program is conditioned on your assurance that you are physically fit to participate. Where training is required (for example, courses or supervised entry-level programs), you will receive appropriate instruction and agree to follow all standards, briefings, and instructions.

You understand that scuba diving, snorkelling, and boat operations involve inherent risks that cannot be eliminated, including but not limited to: currents, waves, surge, weather changes, marine life, boat movement, remote-location constraints, equipment malfunction, physical exertion, and the possibility of serious injury or death.

In order to be accepted as a Guest, you release and discharge Project Laut Diving, its owners, employees, instructors, divemasters, crew, agents, contractors, and other Guests from any and all claims for damages resulting from death or personal injury (including loss of services) arising out of or in connection with your participation in the activities, and/or the ownership, maintenance, use, or operation of any vehicle, vessel, watersport equipment, or other devices involved.

You understand that the remoteness of Nusa Penida and its surroundings, local customs, marine conditions, and/or weather may require modification of activities. Project Laut Diving reserves the right to modify, postpone, or cancel any activities at any time due to unfavourable conditions and/or technical difficulties.

You agree to compensate Project Laut Diving at full current market value for any loss of or damage to Company property or equipment resulting from abuse, misuse, or negligence on your part (normal wear and clearly visible wear-and-tear excluded).

You agree to comply strictly with reasonable terms, rules, and safety instructions issued by staff during the course of the activities.

For any certified scuba diving activities, you must present your most recent certification card or digital proof at registration/check-in.

  • If you cannot show proof of certification, you may be unable to participate. This does not constitute grounds for a refund.
  • You are responsible for ensuring you are suitably qualified for the dives/activities booked, including depth limits, environmental conditions, and training prerequisites.
  • We accept certifications from recognised agencies (including but not limited to SSI, RAID, CMAS, BSAC, SDI, NAUI, and equivalents). If in doubt, contact us before booking.

This certification requirement does not apply to entry-level training programs where certification is not required (for example: Open Water training, and supervised introductory experiences that are delivered according to training standards).

Unless otherwise agreed in writing, full payment is required before participation in single-day recreational activities and courses lasting one or two scheduled days.

For online or remote bookings, full payment must be received by the deadline stated in the booking confirmation or invoice.

A booking is not confirmed until the required payment has been received.

This section applies to:

  • Courses lasting three scheduled days or longer;
  • Divemaster courses and internships;
  • Instructor-level programmes;
  • Conservation internships;
  • Zero-to-Hero programmes; and
  • Any other booking identified as a multi-day, extended or professional programme.

A deposit equal to 50% of the total programme price is required to confirm the booking and reserve the participant’s place.

The remaining 50% balance is payable upon arrival and before the participant begins any programme activity, unless a different deadline is stated in writing in the booking confirmation or invoice.

Where the participant books within 7 days of the intended start date Project Laut Diving may require full payment before confirming the booking.

The 50% deposit is a non-refundable reservation deposit.

The deposit secures limited programme capacity and allows Project Laut Diving to allocate instructors, organise training schedules, reserve operational resources, administer the booking and prepare for delivery of the programme.

The participant’s place is not confirmed until the deposit has been received.

Once received, the deposit will be credited toward the total programme price if the participant attends as booked.

Except where Project Laut Diving cancels the programme under Section 6.8, the deposit is not refundable if the participant cancels, postpones, fails to attend or is otherwise unable or unwilling to participate.

The outstanding balance must be paid upon arrival and before participation begins.

If the balance is not paid when due, Project Laut Diving may:

  • Prevent the participant from beginning the programme;
  • Suspend the booking;
  • Release reserved programme capacity; or
  • Treat the booking as cancelled by the participant.

Any amount already paid remains subject to the cancellation terms below.

Project Laut Diving may withhold certification processing until all amounts due have been paid in full.

Training-agency registrations, digital learning materials, certification fees and other third-party products or services become non-refundable once ordered, assigned, issued, activated or paid for.

Where such costs are not included within the retained deposit, they may be charged separately if the participant authorised them before cancellation.

This section applies to all Multi-Day, Extended, and Professional Programmes.

Once the required 50% reservation deposit has been received, Project Laut Diving may begin preparing the participant’s programme and will enrol the participant in:

  • The first diving course included in the programme, so the participant can begin the required theory and digital learning before arrival; and
  • Any ecology courses included in the programme that are intended to be completed in advance.

The remaining diving course registrations, digital learning materials, and e-kits included in the programme will be assigned only after the full programme balance has been paid.

Course registrations, e-kits, and digital learning materials are issued to the individual participant and may be non-transferable. Once assigned, registered, activated, or issued, they are considered supplied and are non-refundable, including where the participant later cancels, postpones, fails to attend, or does not complete the programme.

Where Project Laut Diving approves a rescheduling request, previously assigned materials may remain valid subject to the rules, validity periods, and transfer restrictions of the relevant training agency.

“Group” bookings are bookings made for 4 or more Guests booking the same activities and qualify for an additional 5% discount. (Does not apply to pro-level courses)

A participant wishing to cancel must provide a clear written cancellation through:

  • Email to the address stated in the booking confirmation;
  • WhatsApp to Project Laut Diving’s official contact number; or
  • Written notice delivered directly to Project Laut Diving management.

Statements that the participant is uncertain, reconsidering, dissatisfied or “may not attend” do not constitute confirmed cancellation.

Cancellation takes effect when Project Laut Diving receives clear written notice that the participant is cancelling.

For single-day activities and courses lasting one or two scheduled days:

The participant may receive a refund, minus:

  • Third-party costs already paid or committed;
  • Payment-processing and transfer costs; and
  • An administrative fee of IDR 250,000 per participant.

Project Laut Diving may offer rescheduling instead, subject to availability.

The participant is eligible for a refund of 50% of the amount paid, minus third-party and payment-related costs.

No refund is due.

If a participant cancels a multi-day, extended or professional programme at any time after paying the 50% reservation deposit:

  • The reservation deposit is non-refundable;
  • Any unpaid balance that has not yet become due will not be charged;
  • Any third-party products or services ordered with the participant’s approval and not covered by the retained deposit remain payable; and
  • No additional cancellation fee applies unless stated in the booking confirmation.

This applies regardless of the reason for cancellation, including:

  • Changes to travel plans;
  • Personal or family circumstances;
  • Illness or injury;
  • Visa or immigration difficulties;
  • Flight or ferry disruption;
  • Failure to arrange accommodation;
  • Failure to arrange transportation;
  • Financial circumstances;
  • Work or study commitments; or
  • A decision not to participate.

Project Laut Diving may, at its discretion, offer rescheduling or booking credit under Section 6.4. take precedence.

A participant does not have an automatic right to reschedule.

Project Laut Diving may approve one change of programme date where operationally possible.

Where rescheduling is approved:

  • The deposit will be transferred to the new programme date rather than refunded;
  • The new programme must normally begin within 12 months of the original starting date;
  • The participant must pay any difference resulting from price increases, changed supplier costs or revised programme requirements;
  • A rescheduling fee of 5% of the total programme price may apply;
  • Training-agency fees and materials already issued cannot be transferred where the provider does not permit transfer; and
  • A later cancellation remains non-refundable.

Rescheduling is subject to programme capacity, instructor availability and written confirmation from Project Laut Diving.

Once the participant has arrived and the remaining balance has become due, the full programme price is payable.

After the participant begins orientation, academic training, confined-water training, diving, conservation activities or any other scheduled programme component:

Additional third-party or certification costs already incurred remain payable.

No refund is due for cancellation, withdrawal or early departure;

No refund is due for unused days, dives, training or services;

The participant remains liable for any outstanding balance; and

Unless expressly stated as included in the booking confirmation, accommodation and transportation are not included in the programme price.

Participants are responsible for:

  • Selecting appropriately located accommodation;
  • Travelling to and from Project Laut Diving;
  • Reaching classrooms, harbours, pools, dive sites and meeting points;
  • Confirming daily transportation arrangements before the programme begins; and
  • Paying all associated transportation costs.

A participant’s choice of accommodation, distance from Project Laut Diving, unwillingness or inability to use a scooter, preference for a private car, lack of a driving licence or failure to arrange transport does not constitute cancellation by Project Laut Diving and does not create an entitlement to complimentary transport, compensation or refund.

Project Laut Diving may assist in finding an independent driver, but transport availability and price cannot be guaranteed unless transport is expressly sold and confirmed as part of the booking.

Participants are responsible for ensuring that they are medically fit to dive and for obtaining any required medical clearance.

A participant who cannot attend or continue because of illness, injury, failed medical clearance or another medical condition remains subject to the ordinary cancellation policy.

Project Laut Diving may offer rescheduling or credit at its discretion where satisfactory medical documentation is supplied.

If Project Laut Diving cancels the entire programme before it begins and cannot provide a reasonable alternative date or equivalent service, the participant may choose:

  • Transfer to another available programme date;
  • Credit toward another Project Laut Diving service; or
  • A refund of the amount paid to Project Laut Diving for the cancelled programme.

Project Laut Diving may alter schedules, instructors, boats, dive sites, training locations and the order of programme activities where reasonably required for safety, weather, sea conditions or operational reasons. Such adjustments do not constitute cancellation of the programme.

Where a refund is due, Project Laut Diving may deduct:

  • Non-refundable third-party charges;
  • Banking, payment-processing and transfer fees; and
  • Any amount expressly permitted under these Terms.

Approved refunds will normally be processed within 30 days after the refund amount and payment details have been confirmed.

No refund, credit or compensation is due where a participant:

  • Does not arrive for the programme;
  • Fails to attend at the agreed time or location;
  • Arrives too late to participate;
  • Misses a boat or scheduled activity;
  • Cannot attend because transport was not arranged;
  • Cannot locate the meeting point; or
  • Fails to read reasonable schedule or meeting-point communications.

For multi-day, extended and professional programmes, the participant’s 50% deposit remains non-refundable.

Where the participant has arrived and the full balance has become due, the full programme price remains payable.

No refund or compensation is due where a participant:

  • Uses fewer programme services than were included.
  • Withdraws after the programme begins;
  • Leaves before the scheduled completion date;
  • Chooses not to participate in a dive, class or activity;
  • Takes personal days;
  • Declines an alternative activity;
  • Decides not to dive because of fatigue, anxiety, seasickness, water temperature, visibility, current or personal preference; or
  • Uses fewer programme services than were included.

Payment and attendance do not guarantee certification.

Certification is awarded only where the participant completes all required knowledge, skills, dives, assessments, conduct standards and prerequisites.

No refund is due where certification is delayed, withheld or not awarded because the participant:

  • Does not meet required standards;
  • Fails to complete required work;
  • Misses scheduled training;
  • Does not meet prerequisite requirements;
  • Does not demonstrate safe conduct;
  • Does not have sufficient time to complete the programme; or
  • Declines required remedial training.

Additional training, dives, instructor time, accommodation, materials and certification costs may be charged separately.

Project Laut Diving may suspend or terminate participation where a participant behaves unsafely, ignores instructions, provides false information, attends while impaired, threatens or harasses others, damages property or otherwise creates a serious safety or operational concern.

No refund is due where participation is terminated for these reasons.

We strongly urge Guests to purchase a fully comprehensive travel insurance policy at the time of reservation. At minimum, your travel insurance should cover:

  • medical expenses and emergency treatment,
  • accidents and personal liability,
  • baggage and personal effects, and
  • trip cancellation and interruption.

We also strongly recommend choosing an insurer that covers travel disruption caused by transportation issues (including but not limited to aircraft or ferry cancellations, technical malfunctions, delays), and disruption due to natural events such as volcanic activity, earthquakes, flooding, and severe storms.

Policy consequence: If you are unable to attend your booked activities on the agreed date because of travel disruption or natural events, no refund will be granted by Project Laut Diving under these Terms. Your recourse, where available, is through your insurance provider.

Having travel insurance is a personal choice. Having insurance that covers the specific activities you engage in—especially scuba diving—is your responsibility and is required.

You agree that:

  • you are solely responsible for obtaining insurance covering the activities you book with us (including but not limited to scuba diving), and
  • Project Laut Diving cannot be held liable and is not responsible for financial losses, medical expenses, evacuation costs, treatment costs, or any other costs arising from incidents occurring during activities arranged, booked, or performed with us.

Many travel insurance policies include diving coverage or offer it as an add-on. You should confirm the details directly with your insurer before booking.

If you do not have appropriate coverage, we strongly advise you to purchase short-term dive insurance with Dive Alert Network (DAN). We can assist with DAN subscription at our office prior to diving.

If you choose not to carry travel insurance and/or adequate coverage for your activities, you do so at your own risk. Project Laut Diving will not be responsible or liable for financial loss caused by any reason whatsoever, including missed bookings, medical costs, evacuation costs, or trip interruption.

Scuba diving, snorkelling, and boat travel involve risks. These risks exist even when all standards are followed.

Project Laut Diving:

  • will not be responsible for personal injury, property damage, or wrongful death that may occur during activities arranged, booked, or performed with us;
  • is not liable for accidents resulting from acts or omissions of third parties; and
  • is not responsible for loss, theft, or damage to personal items including but not limited to: personal dive equipment, cameras, video equipment, phones, strobes, passports, jewellery, flight tickets, and other valuables.

Project Laut Diving is not qualified to provide medical advice. If you are uncertain about a medical matter related to diving or snorkeling, you must obtain advice from a qualified medical practitioner before participating.

For any dive course or diving activity—regardless of prior experience—Guests must complete a medical questionnaire in good faith.

Before participating in activities in remote locations, you should ensure you are reasonably fit. Many of our activities are physically demanding. If you experience discomfort, displeasure, or pain due to your inability to perform an activity, this is not grounds for complaint or refund.

If you have any health conditions, are taking medication, or have had illness, injury, or surgery that may affect you while diving, you must inform staff in advance.

Failure to disclose relevant information may result in your being refused participation for safety reasons. If we have valid reasons to suspect a potentially dangerous medical condition, we may require you to provide medical clearance before participating or continuing. If clearance is requested and not provided, no refund or compensation will be issued for activities missed.

If you are allergic to any medication or have dietary restrictions or food allergies, you must communicate this clearly in writing during the booking process. If not disclosed in advance, it may be difficult or impossible for us to accommodate your needs.

If departure of a dive trip is not advisable—or may be dangerous to the life or health of passengers or to the vessel—due to conditions including but not limited to: severe weather, perils of the sea, Acts of God, political incidents, or force majeure (including pandemic, tsunami, typhoon, severe storms, earthquakes), the captain has the discretion to delay or cancel departure.

If such events occur during a trip and returning to port is not advisable, the captain may delay return until conditions allow and adjust the itinerary, including cancellation or re-sequencing of services.

Additionally, in the event of political unrest, military conflict, flight cancellations, or any other risk to Guests or vessels, we may reschedule bookings.

Refund rule: We only refund money where Project Laut Diving itself cancels a trip, except where cancellation arises for reasons defined here as Force Majeure. We accept no financial responsibility for itinerary changes or cancellations caused by circumstances outside our control.

We reserve the right to rearrange the order of an itinerary, cancel or substitute elements, or change sites/times without notice when local conditions, unforeseen events, or technical difficulties require it.

Our dive professionals may refuse or stop a Guest’s participation at their discretion based on safety and conduct, including but not limited to:

  • breach of marine park rules/regulations,
  • handling or harassing marine life,
  • drugs and/or alcohol consumption before or between dives, or
  • failure to abide by safe diving practices.

In such cases, no refund will be granted for missed dives and/or activities.

Where accommodation, transport, or other services are provided by third parties (“Service Providers”), Project Laut Diving acts solely as an agent. Any dispute regarding outsourced services must be taken up directly with the Service Provider under their own terms and conditions.

Guests acknowledge that Project Laut Diving shall not be liable in contract or tort for injury, damage, loss, delay, additional expense, or inconvenience caused directly or indirectly by us or by circumstances beyond our control, including but not limited to: war, civil disturbance, theft, delays, severe weather, Acts of God, Acts of Government, accidents to or failure of machinery/equipment/vehicles, or industrial disputes.

We are not liable for dissatisfaction based on personal opinion regarding service standards, nor for disappointment, distress, or lack of enjoyment arising from any act or omission whatsoever.

We will investigate justified complaints in writing relating to specific and tangible inadequacies of facilities or services provided directly by us. Complaints must be submitted in writing within 7 days to allow remedial action at the time.

If something is not right, you agree to notify staff immediately so we can attempt to resolve the issue on the spot. If the staff present cannot resolve the issue, request to speak with management.

Formal complaints must be lodged in writing within 7 days and should include dates, names, and a clear factual description.

  • We guarantee the number of dives booked; however, specific dates, times, sites, and marine life encounters are not guaranteed. References to these are guidance only and do not constitute guarantees.
  • You are responsible for notifying us promptly of any changes to your booking details. We are not responsible for problems caused by failure to follow our instructions or documentation requirements.
  • Rates include taxes unless otherwise stated. Rates may change without prior notice and are only guaranteed once payment is received.
  • It is your responsibility to avoid impossible or unsafe bookings (for example, booking courses you are not eligible for or diving less than 18 hours before flying).
  • If there is an error in price or detail shown on our website or communications, we reserve the right to revise the terms in the spirit of mutual satisfaction and/or cancel the contract relating to that error without liability.
